Description of Record(s) Requested: 

  1. All written communications (including, but not limited to, email(s), text message(s), instant messenger message(s), and letter(s)) between the Union named Sheet Metal Workers International Association, Local 66 (hereinafter “Local 66”[1]), and the Port of Seattle (including all of its commissioners, representatives and/or agent(s)). This request only seeks documents from March 22, 2017 to January 15, 2018 between the above parties concerning any and/or all of the following subjects:Northshore Sheet Metal, Inc.[2];
    1. Project Labor Agreement (also referred to as PLA);
    2. Norwegian Cruise Line (also referred to as NCL);
    3. Pier 66;
    4. Turner Construction Company (also referred to as Turner).
  2. All notes, calendar entries, recordings and other documents related to any verbal communication(s) between Local 66, and the Port of Seattle (including all of its commissioners, representatives and/or agent(s)). This request only seeks documents from March 22, 2017 to January 15, 2018 between the above parties concerning any and/or all of the following subjects:
    1. Northshore Sheet Metal, Inc.;
    2. Project Labor Agreement (also referred to as PLA);
    3. Norwegian Cruise Line (also referred to as NCL);
    4. Pier 66;
    5. Turner Construction Company (also referred to as Turner).
  3. All written communications (including, but not limited to, email(s), text message(s), instant messenger message(s), and letter(s)) between the organization named the Seattle Building & Construction Trades Council (hereinafter “SBCTC”[3]), and the Port of Seattle (including all of its commissioners, representatives and/or agent(s)). This request only seeks documents from March 22, 2017 to January 15, 2018 between the above parties concerning any and/or all of the following subjects:
    1. Northshore Sheet Metal, Inc.;
    2. Project Labor Agreement (also referred to as PLA);
    3. Norwegian Cruise Line (also referred to as NCL);
    4. Pier 66;
    5. Turner Construction Company (also referred to as Turner).
  4. All notes, calendar entries, recordings and other documents related to any verbal communication(s) between SBCTC, and the Port of Seattle (including all of its commissioners, representatives and/or agent(s)). This request only seeks documents from March 22, 2017 to January 15, 2018 between the above parties concerning any and/or all of the following subjects:
    1. Northshore Sheet Metal, Inc.;
    2. Project Labor Agreement (also referred to as PLA);
    3. Norwegian Cruise Line (also referred to as NCL);
    4. Pier 66;
    5. Turner Construction Company (also referred to as Turner).
  5. All internal written communications (including, but not limited to, memoranda, email(s), text message(s), instant messages, and letter(s)) between commissioners, agents and/or employees of the Port of Seattle. This request only seeks documents from March 22, 2017 to January 15, 2018 between the above parties concerning any and/or all of the following subjects:
    1. Northshore Sheet Metal, Inc.;
    2. Local 66;
    3. Sheet Metal Workers (also referred to as SMW);
    4. Sheet Metal Workers International Association (also referred to as SMWIA);
    5. International Association of Sheet Metal, Air, Rail, and Transportation Workers (also referred to as SMART);
    6. Project Labor Agreement (also referred to as PLA);
    7. Norwegian Cruise Line (also referred to as NCL);
    8. Pier 66;
  6. All electronic stored information (“ESI”), including emails, text messages, word documents, spreadsheets, note files, video recordings, audio recordings, and any other date, in native format (e.g., .pst files for emails, .doc or .docx files for Word, etc.) that mention, refer to, or relate to Northshore Sheet Metal Inc. and/or any other Carpenter-Signatory Employer[4] from November 1, 2016 to January 15, 2018. All responsive documents are requested, and a search under the following terms should occur:
    1. Northshore Sheet Metal, Inc.;
    2. “Boycott”
    3. “Strike”
    4. “Decert”
    5. “Decertification”
    6. “Picketing”
    7. “Meyer”
    8. “Elbert”
    9. “Cobra”
    10. “Rat”
    11. “Rat Inc”
    12. Dinkus

 

Please provide an estimate of total costs prior to incurring any charges for these documents.  Please provide these documents in their native electronic format. 

 

[1] Sheet Metal Workers International Association, Local 66 as used in all the requests contained in this request, includes any and all employees, Directors, Officers, members, assigns, agents, guardians, and representatives, including attorneys and accountants, acting on behalf of Local 66.  This includes, but is not limited to, Tim Carter (timc@smw66.org), Aaron Bailey (aaronb@smw66.org), Mark Nelson, Pete Fasano, Dennis Katsel, Rod Lyon, Bryan Johnson, Sam Hem, Mark Riker, Kal Rohde, Steve Musser, Jeff Stowe, Lance Deyette, Chris Grounds, Russel Brown, Brian Camus, Quinn Peterson, Kevin Wildes, and Dan Hutzenbiler.

[2] “Northshore Sheet Metal, Inc.” as used in all requests contained in this public records request includes any and all parent companies, subsidiaries, successors, owners, Board of Directors, Officers, employees, agents, and/or representatives.  This list includes, but is not limited to Northshore Exteriors, Jeff Meyer, Dan Meyer, Brian Elbert, Erland Milliken, Dave Masters, and Chris Hilgenfeld and Erik Laiho.

 

[3] The Seattle Building and Construction Trades Council as used in all the requests contained in this request, includes any and all employees, Directors, Officers, members, assigns, agents, guardians, and representatives, including attorneys and accountants, acting on behalf of the SBCTC.  This includes, but is not limited to, Monty Anderson (monty@seattlebuildingtrades.org), Lisa Bogardus (lisa@seattlebuildingtrades.org), and Dan Hutzenbiler.

[4] “Carpenter-Signatory Employer” includes any Employer in the architectural metal siding (also referred to as sheet metal) trade in Western Washington that is signatory to the Pacific Northwest Regional Council of Carpenters.  This includes, but is not limited to, Cobra Building Envelope Contractors (“Cobra”), Insulpro, Kenco, and MD Exteriors.
