To Whom It May Concern:

 

Pursuant to the State Open Records law, Wash. Rev. Code Ann. Sec. 42.56.001 to 42.56.904, I write to request the following:

  • Any and all records, physical or electronic, prepared, owned, used, or retained by the Port of Tacoma, Port of Seattle, or The Northwest Seaport Alliance (individually or collectively, the "District") relating to the District's consideration of developing an auto terminal at what is known as or has been referred to ac;; "Parcel 77'', the "Kaiser berth or terminal," or the "Parcel 77 Auto Terminal Development project" and as described in that presentation to the Managing Members at the NW Seaport Alliance November 7, 2017 meeting (collectively, "Parcel 77 Project"), including, but not limited to:

o           Any and all records, physical or electronic, prepared by any consultant and delivered to the District relating to the District's consideration of developing an auto terminal at what is known as the "Parcel 77 Project" or the "Kaiser berth" including, without limitation, any designs, budgets, reports, memoranda, notes, contracts, or communications produced by Transdevelopment Group.

  • Any and all records, physical or electronic, prepared, owned, used, or retained by the District related to the possible purchase, lease, license, mortgage, management, or any other transaction involving the Parcel 77 Project, including, but not limited to, any term sheet, letter of intent, or other written agreement, binding or non-binding, offer, counteroffor, and/or communication between the District and Wallenius Wilhelmsen Logistics ("WWL").

 

  • Any and all records, physical or electronic, prepared, owned, used, or retained by the District related to communications between any person or entity and any of the District's managing members, commissioners, management, and/or staff regarding the Parcel 77 Project.
  • Any and all notices, agendas, or minutes, physical or electronic, prepared, ovtned, used, or retained by the District related to the District's consideration and/or decision to pursue the Parcel 77 Project, including any materials circulated for consideration in connection with any such decision.
  • Any and all records, physical or electronic, prepared by any consultant and delivered to the District relating to the District's consideration of any development at Parcel 77, including any of the records described above to the extent they are in the possession of any consultant, contractor, or agent of the District.

Please do not let an inability to collect or release any part of this request hinder you from collecting and releasing other parts.

Please advise on how long you think it will take before the records that have been requested can

be produced.

Additionally, please provide whatever records you have already assembled as soon as possible. You can supplement that later if you have not yet assembled or reviewed all of the requested records.

As provided by the Open Records law, 1 will expect your response within five (5) business days. lf you choose to deny this request, please provide a written explanation for the denial, including a reference to the specific statutory exemption(s) upon which you rely. Also, please provide all segregable portions of otherwise exempt material.
